These Terms of Service (“Terms”) form a binding agreement between you and BLOY Loyalty (“we,” “us,” or “our”). By creating an account, installing, or using our application and related services (the “Service”), you confirm that you have read, understood, and agree to these Terms. If you do not agree, you may not access or use the Service.


1. Eligibility & Acceptance

1.1 Who Can Use the Service
You must be at least 18 years old, or the legal age of majority in your jurisdiction, and capable of entering into a binding contract to use the Service.

1.2 Acceptance
By using the Service, you accept these Terms on your own behalf or on behalf of a company or organization you represent. If you are acting for an organization, you confirm you have authority to bind it to these Terms.


2. Our Service

BLOY Loyalty provides tools to help merchants design and manage loyalty and rewards programs. Features may include, but are not limited to:

  • Creating, customizing, and launching loyalty campaigns

  • Managing customer participation, points, and rewards

  • Integration with e-commerce platforms and third-party tools

  • Analytics and performance reporting

We may improve, add, limit, or discontinue certain features at any time. When significant changes occur, we will make reasonable efforts to notify you.


3. Accounts & Security

3.1 Account Creation
To use the Service, you must register with accurate and complete information. You agree to keep your contact and billing details current.

3.2 Account Responsibility
You are solely responsible for safeguarding your login credentials and for any activity conducted through your account. If you suspect unauthorized access, you must notify us immediately at [email protected].


4. Subscription, Fees & Billing

4.1 Plans
We offer both free and paid subscription plans. Features and usage limits vary by plan.

4.2 Payments

  • Development stores on Shopify may access paid plans at no cost. For merchants on a Shopify paid plan, a valid payment method is required to activate and maintain a paid subscription.

  • Fees are billed on a recurring basis (monthly or annually).

  • Payments are non-refundable unless required by law.

4.3 Changes & Cancellations

  • You may cancel your subscription anytime in your account settings; access will continue until the end of the billing cycle.

  • We may adjust plan prices or features with advance notice.


5. Acceptable Use

When using the Service, you agree not to:

  • Use it for unlawful, fraudulent, or misleading activities

  • Interfere with or disrupt the Service’s operation

  • Introduce viruses, malware, or harmful code

  • Exploit or misuse data belonging to Customers or Merchants

  • Infringe intellectual property, privacy, or other legal rights

We may suspend or terminate your account if you violate this section.


6. Data & Privacy

We process personal data as described in our Privacy Policy. By using the Service, you consent to such processing.

Merchants are responsible for ensuring their use of customer data through the Service complies with applicable laws, including data protection and marketing regulations.


7. Disclaimers

The Service is provided “as is” and “as available.”
We do not guarantee uninterrupted operation, error-free performance, or that results will meet your expectations. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.


8. Limitation of Liability

To the extent allowed by law:

  • BLOY Loyalty will not be liable for indirect, incidental, special, or consequential damages, including lost profits or revenue.

  • Our maximum liability under these Terms will not exceed the fees you paid to us in the 12 months prior to the claim.


9. Termination

  • You may stop using the Service and close your account at any time.

  • We may suspend or terminate your account if you breach these Terms, misuse the Service, or cause harm to BLOY Loyalty or other users.

  • Upon termination, your right to use the Service ceases immediately.


10. Updates to Terms

We may revise these Terms occasionally. Updated versions will be posted on our website, with the “Effective Date” changed accordingly. Material changes will be communicated by email or within the Service. Continued use after updates means you accept the new Terms.
